fa اصول حفاظت و مدیریت آب‌های مشترک در سطح بین‌االملل عمومی Ggeneral پژوهشي Research <div style="text-align: justify;"><strong><span style="font-family:B Lotus;"><span style="font-size:11.0pt;">بهداشت عمومی آب‌های مشترک در حفظ سلامت انسان به‌عنوان &laquo;بزه‌دیده انسانی&raquo; و سلامت محیط ‌زیست و منابع طبیعی به‌عنوان &laquo;بزه‌دیده سبز&raquo; (بزه‌دیده خاموش) به‌خاطر ماهیت فراجغرافیایی و عدم انحصار آثار و عوارض نقض آن در قلمرو یک دولت خاص اهمیت ویژه‌ای در حقوق بین‌الملل عمومی دارد. لذا حمایت از آسیب‌دیدگان نقض بهداشت عمومی آب‌های مشترک توسط نهادهای بین‌المللی و دولت‌های عضو جامعه جهانی ضروری است. سیاست حمایتی، شاخه‌ای از سیاستگذاری عمومی است که &laquo;حمایت‌های قانونی مختلف از آسیب‌دیدگان نقض هنجارها و مقررات با سیاست‌های منسجم و استفاده از اصول راهبر&raquo; را هدف اصلی خویش قرار می‌دهد. این اصول، مجموعه آموزه‌ها و راهبردهای منسجمی هستند که خط ‌مشی و سیاست‌های کلان و به تبع آن کیفیت وضع قوانین و مقررات اجرایی را تعیین می‌کند و همانند سنجه‌ای کیفی امکان پایش قوانین و مقررات را فراهم می‌سازد. پژوهش حاضر مطالعۀ مروری است که اصول سیاست حمایتی حفاظت و مدیریت بهداشت آب‌های مشترک را در معاهدات و رویه‌های قضایی بین‌المللی بررسی کرده است. اصولی که در این منابع مطرح شده‌اند در سه دسته &laquo;عدالت‌محور&raquo;، &laquo;همکاری‌محور&raquo; و &laquo;انصاف‌محور&raquo; قابل طبقه&shy;بندی هستند. این اصول می‌توانند در سیاست حمایتی حقوق بهداشت آب ایران استفاده شوند.</span></span></strong></div> <div style="text-align: justify;">Public health of common waters in protecting the human&#39;s health is considered as &quot;human delinquent&quot; and environmental and natural health as &quot;green offender&quot; (silent offender) due to the terrestrial nature and the lack of the monopoly of works; so, the consequences of violating it in the territory of a particular state are of particular importance in the international public law. Therefore, protection of the harm caused by the breach of the public health of common waters is imperative by international institutions and States members of the international community. The supportive policy is a branch of public policy that &quot;puts&quot; various legal protections from the perpetrators of the violations of norms and regulations &quot;in the form of coherent policies using its principal principles. These principles are a set of doctrines and coherent strategies that determine the policy and consequently, the way in which laws and regulations are imposed; as with the qualitative measure, it provides for the monitoring of rules and regulations. To make the present study, a review of the principles that underlie the principles of public health policy in international treaties and procedures is presented. The principles outlined in these sources are categorized into three categories: &quot;justice-oriented&quot;, &quot;cooperative-oriented&quot; and &quot;fair-minded&quot;.
